Welcome to Freeland (“we,” “us,” “our”). By accessing or using Freeland’s website, mobile app, or services (collectively, the “Platform”), you (“you,” “user,” “buyer,” or “seller”) agree to the following Terms of Service (“Terms”). If you do not agree, you may not use the Platform.

1. Eligibility

You must be at least 18 years old to use Freeland. By using the Platform, you represent that you have the legal capacity to enter into these Terms.

2. Marketplace role

Freeland is a community-driven marketplace platform that enables users to list, buy, and sell goods.

Freeland:

  • is not the buyer or seller in any transaction
  • does not own or inspect items listed
  • does not guarantee the accuracy of listings
  • does not handle shipping, payment disputes, or returns between users

All transactions occur directly between users.

3. User accounts

To use certain features, you must create an account and provide accurate, up-to-date information. You are responsible for:

  • maintaining the confidentiality of your account
  • all activity under your account
  • notifying us immediately if you believe your account has been compromised

We may suspend or remove accounts that violate these Terms.

4. Acceptable use

You agree not to:

  • violate any laws or regulations
  • list prohibited, illegal, unsafe, or stolen items
  • misrepresent items or provide false information
  • engage in fraud, scams, or deceptive behavior
  • interfere with the operation of the Platform
  • collect user data without consent
  • use Freeland to harass, threaten, or harm others

We reserve the right to remove accounts or content violating these rules.

5. Listings and selling

Sellers are responsible for:

  • the accuracy of item descriptions
  • setting prices
  • shipping items promptly (if applicable)
  • complying with all applicable laws
  • ensuring items are safe and legitimate

Freeland may moderate, remove, or restrict listings at its discretion.

6. Buying

Buyers are responsible for:

  • reviewing item details before purchasing
  • communicating clearly with sellers
  • completing payment in accordance with platform rules

Buyers acknowledge that Freeland is not responsible for item quality, accuracy, authenticity, or condition.

7. Fees

Freeland currently charges no transaction fees for standard buying and selling.

Freeland may offer optional premium features or subscriptions. If pricing changes, users will be notified before new fees apply.

8. Payments

Payments between buyers and sellers may be handled by third-party payment processors.

By using the Platform, you agree to comply with the processor’s separate terms and policies.

Freeland is not responsible for:

  • payment failures
  • chargebacks
  • refunds or cancellations
  • financial disputes between users

9. Shipping and delivery

Shipping arrangements are the sole responsibility of buyers and sellers.

Freeland is not responsible for:

  • lost, damaged, or delayed shipments
  • shipping costs
  • delivery confirmation or tracking
  • disputes regarding item condition on arrival

10. Disputes between users

Freeland is not required to mediate disputes between buyers and sellers. Users should attempt to resolve issues respectfully and directly.

In cases of fraud or illegal activity, Freeland may assist law enforcement when required.

11. Content ownership

You retain ownership of content you post (photos, descriptions, etc.).

By posting content, you grant Freeland a non-exclusive, royalty-free license to use, display, and distribute that content as needed to operate the Platform.

You agree not to upload content that violates the rights of others.

12. Platform availability

We may modify, suspend, or discontinue parts of the Platform at any time without notice.

We are not liable for downtime, technical issues, or changes to features.

13. Termination

We may suspend or terminate your account if:

  • you violate these Terms
  • you engage in harmful or fraudulent behavior
  • we believe your activity poses risk to the community

You may discontinue use at any time by closing your account.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how your data is collected and used.

15. Limitation of liability

To the fullest extent permitted by law:

  • Freeland is not liable for damages, losses, or disputes arising from user interactions or transactions
  • Freeland provides the Platform “as is” without warranties of any kind
  • You use the Platform entirely at your own risk

16. Indemnification

You agree to indemnify and hold Freeland harmless from any claims, damages, or losses arising from:

  • your use of the Platform
  • your interactions with other users
  • your violation of these Terms
  • your posted content

17. Changes to these Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance of the new Terms.

18. Governing law

These Terms are governed by the laws of the United States and the Commonwealth of Massachusetts. Any disputes must be resolved in courts located in Massachusetts.
